The ownership of the property will be transferred to the buyer only upon full payment of the total consideration and after the execution of the sale deed. The buyer must comply with all legal formalities for the registration of the property as per the laws governing property ownership in India.
All bookings will be confirmed only after the payment of the booking amount as specified by Nyati Group. Subsequent payments must be made as per the payment schedule provided. Delayed payments may incur interest or penalties, and failure to adhere to the payment schedule may result in the cancellation of the booking, subject to refund policies.
Nyati Group reserves the right to make changes or modifications to the project plan, layout, designs, and amenities as per regulatory approvals or other considerations. Any such changes will be communicated to the buyer, and any deviations will be in compliance with the applicable laws.
In case of cancellation by the buyer, Nyati Group reserves the right to withhold a portion of the booking amount as a cancellation fee. The exact refund amount and procedure will be subject to the terms of the booking agreement signed by the buyer and Nyati Group.
Possession of the property will be given as per the date mentioned in the agreement. However, in the event of unforeseen circumstances or delays due to legal, governmental, or other uncontrollable factors, Nyati Group may extend the possession date without liability for compensation.
The property shall be used strictly for residential purposes. Any alteration, modification, or commercial use of the property without prior approval from Nyati Group and the relevant authorities will not be permitted.
Post-possession, residents will be required to pay maintenance charges as specified by the developer or the future housing society formed by the residents. The maintenance fee covers common area expenses, amenities upkeep, and security services.
Any disputes arising from the sale, possession, or use of the property shall be subject to the jurisdiction of the courts in Pune. Efforts will be made to resolve disputes amicably through mediation before pursuing legal action.
Buyers are expected to comply with all local, state, and national laws governing property ownership, taxation, and usage. Non-compliance with legal requirements may result in penalties or legal action.
Nyati Group shall not be held responsible for any delay or failure in the delivery of the project due to events beyond its control, including but not limited to natural disasters, strikes, labor shortages, governmental actions, or any other force majeure event.
By proceeding with the booking, buyers acknowledge and accept these terms and conditions and agree to abide by the guidelines set forth by Nyati Group for the Nyati Emerald.
